KUIZ TAFSIRAN PEKERJA DI BAWAH AKTA KERJA 1955 (AKTA 265) DAN JIKA JAWAPAN SEMUA BETUL, ANDA TELAH MEMAHAMI AKTA INI.

COMPLAINTS AND INQUIRIES
Director General’s power to inquire into complaints
69. (1) The Director General may inquire into and decide any dispute between an employee and his employer in respect of wages or any other payments in cash due to such employee under—
(a) any term of the contract of service between such employee and his employer;
(b) any of the provisions of this Act or any subsidiary legislation made thereunder; or
(c) the provisions of the Wages Councils Act 1947 [Act 195] or any order made thereunder,
and, in pursuance of such decision, may make an order in the prescribed form for the payment by the employer of such sum of money as he deems just without limitation of the amount thereof.

D. Kuasa siasatan (Seksyen 69B)
Additional powers of Director General to inquire into complaints
69B. (1) Notwithstanding the provisions of this Act, the powers of the Director General under paragraph 69(1)(a) shall extend to employees whose wages per month exceed two thousand ringgit but does not exceed five thousand ringgit.

Persoalan : Bolehkan pekerja wanita bergaji RM 2,500.00 menuntut elaun bersalin di bawah Seksyen 69 Akta Kerja 1955?

1.      Pindaan Akta Kerja 1955 (2012), telah memperkenalkan seksyen 44A, yang memanjangkan pemakaian perlindungan bersalin kepada semua 'pekerja' wanita;

...“Application of this Part irrespective of wages of female employee
44A. Notwithstanding paragraph 1 of the First Schedule, this Part extends to every female employee who is employed under a contract of service irrespective of her wages.” ...

2.      Seksyen 2 Akta Kerja 1955 menafsirkan;

...“employee” means any person or class of persons—

(a) included in any category in the First Schedule to the extent specified therein; or...

1. Any person, irrespective of his occupation, who has entered into a contract of service with an employer under which such person’s wages do not exceed two thousand ringgit a month...

Pandangan 1
1.      Memandangkan seksyen 44A telah menghapuskan shilling gaji dua ribu ringgit pada para 1 Jadual Pertama, mana-mana 'pekerja' wanita berhak membuat tuntutan di bawah seksyen 69 Akta Kerja 1955 dan Ketua Pengarah perlu menyiasat tuntutan berkaitan dan membuat keputusan.
2.      Seksyen 44A dibaca bersama-sama seksyen 69 kerana kelayakan yang diberi melalui seksyen 44A adalah tidak logik tidak disertakan kuasa Ketua Pengarah untuk menyiasat dan membuat keputusan untuk seksyen 69 berkaitan isu berbangkit di bawah seksyen 44A.
3.      Semasa membaca 44A, berkaitan perlindungan bersalin, tafsiran 'employee' di bawah para 1 Jadual Pertama telah dibuka dan melayakkan mana-mana 'pekerja' wanita menuntut perlindungan bersalin di bawah seksyen 69 Akta Kerja 1955.

Pandangan 2
Secara asas peruntukan Akta Kerja 1955, melindungi segolongan pekerja sahaja dan para 1 Jadual Pertama telah menetapkan shilling dua ribu ringgit. Melainkan dinyatakan dengan jelas seperti seksyen 44A maka semua rujukan/ tafsiran 'pekerja' akan merujuk kepada Jadual Pertama dan ini termasuk seksyen 69 Akta Kerja 1955.

1.      Sebelum pindaan seksyen 69B, tafsiran pekerja untuk setiap peruntukan hanya merujuk kepada pekerja di bawah Jadual Pertama dan seksyen 69 Akta Kerja 1955 tidak terkecuali yang membolehkan 'pekerja' di bawah Jadual Pertama sahaja memfailkan tuntutan di bawah seksyen 69 Akta Kerja 1955.

2.      Selepas pindaan memasukkan seksyen 69B tafsiran pekerja untuk seksyen 69B merujuk kepada pekerja bergaji melebihi satu ribu lima ratus ringgit hingga lima ribu ringgit dan tuntutan mereka difailkan dibawah seksyen 68B dan bukan seksyen 69. Lain-lain seksyen/ peruntukan masih mengekalkan tafsiran 'pekerja' seperti seksyen 2/ Jadual Pertama termasuk untuk seksyen 69 dan hanya 'pekerja' di bawah Jadual Pertama sahaja boleh membuat tuntutan di bawah seksyen 69 Akta Kerja 1955.

3.      Selepas pindaan 2012, wujud satu lagi tafsiran 'pekerja' iaitu untuk seksyen 44A berkaitan perlindungan bersalin dan 81G berkaitan gangguan seksual iaitu menghapuskan shilling gaji para 1 Jadual Pertama. Seksyen 69B dipinda untuk menafsirkan 'pekerja' dibawah seksyen itu ialah 'pekerja' bergaji dua ribu hingga lima ribu ringgit dan para 1 Jadual Pertama dipinda kepada dua ribu ringgit. Walaupun pindaan ini seolah-olah menyebabkan mana-mana 'pekerja' di bawah seksyen 44A dan 81G dilindungi Akta Kerja 1955 dan Ketua Pengarah Tenaga Kerja boleh mendengar dan memutuskan pertikaian berkaitan peruntukan berkaitan, kedudukan seksyen 69 Akta Kerja kekal dan hanya “pekerja” di bawah Jadual Pertama sahaja boleh menuntut di bawah seksyen 69 Akta Kerja 1955.
