REVISION - CONTROL AND LEAVES

Control test is one of the way to determine whether a person is engaged in a contract of service or another form of relationship.

4 main item that are being considered are

1. What
2. How
3. Where
4. WHEN

The 'when' consists working days and working hours. Governed by legislation, employers are given the liberty to determine when jobs to be executed.

Leaves (cuti) play a vital part in this segments of control. Protected by laws, an employer can't take actions against an employee who doesn't attend work during working days stipulated by the employer if he is on leaves guaranteed by statutory provision provided conditions set out on those provision's are met.

Another way is by prior permission by the employer so as the employee is permitted not to attend those working days.
